Learned counsel for the petitioner submits that learned Appellate Court has wrongly reversed the well reasoned finding recorded by the Judicial Magistrate First Class whereby the trial Court has convicted the respondent/accused under Section 138 of the Negotiable Instruments Act. 5. Heard learned counsel for the petitioner and perused the order passed by the trial Court as well other relevant documents. 6. On due consideration, leave as prayed for by counsel for the petitioner is granted. 7. Let the petition filed by the petitioner be registered as Acquittal Appeal.
