Hon'ble Manoj Bajaj,J. Petitioner is aggrieved against the order dated 15.01.2025 passed by Comissioner, Basti, Division Basti in Case No.63 of 2025, under Section 6 of the U.P. Control of Goondas Act, 1970, whereby his application seeking stay of the operation of the externment order dated 31.12.2024 passed by the Additional District Magistrate (F&R), Basti and challenged through statutory appeal has been declined. Heard learned counsel for the parties. A perusal of the order dated 15.01.2025 reveals that while declining the interim relief of stay, the appeal was fixed for hearing on 17.02.2025, which according to the learned counsel is still pending adjudication. There is nothing on record to indicate that the delay in adjudication of main appeal is not attributed to the petitioner. That apart, considering the limited challenge in the writ petition, this Court is not inclined to exercise the extraordinary writ jurisdiction, as alternatively the petitioner can press his main appeal before the appellate authority.
