The instant writ petition has been filed for following relief: "(i) issue a writ, order or direction in the nature of certiorari quashing the impugned notice dated 03.02.2025 passed by respondent no.2 i.e. District Magistrate, Auraiya in Case No.14 of 2025 (State of U.P. vs. German and others) u/s128 of U.P. Revenue Code, 2006. (ii) issue a writ, order or direction in the nature of mandamus direct the respondent no.3 i.e. Sub-Divisional Magistrate Bidhuna, District - Auraiya to decide the representation of the petitioner dated 01.02.2025 within stipulated as fixed by this Hon'ble Court." 4. From the perusal of the writ petition and the relief claimed in the writ petition, it is apparent that notice issued to the petitioner under Section 128 of UP Revenue Code, 2006 is under challenge. 5. Learned Standing Counsel has submitted that the petitioner can file his objections to the notice and a direction be issued to the respondent no.2 to consider the objections filed by the petitioner, if any. 6. The writ petition is disposed of with liberty to the petitioner to file objections to the notice issued to him in proceedings under Section 128 and, in case, such an objections are filed, the same shall be considered and decided in accordance with law.
