GP FOR HOME 3 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....to issue a Writ Order or direction particularly, one in the nature of writ of Mandamus declaring the action of the respondent no 2 in not initiating any enquiry on the report of the petitioner dated 24.09.2020 as the 3rd respondent committed serious irregularities in discharging his duties as illegal, arbitrary and violation of principles of natural justice and also violations of Article 14,15,16,19 and 300-A of the Constitution of India and consequently direct the respondent No 2 to initiate departmental enquiry and pass.” 2. Heard Sri Jada Sravan Kumar, learned counsel for the petitioner, and Sri V. Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that they have given a report to the Superintendent of Police making some allegations against the Sub-Inspector of Police, in whose hands the husband of the petitioner suffered injuries during custody before being produced before the concerned Magistrate Court relating to Crime No.145 of 2020 dated 12.09.2020 for the offences punishable under Sections 323, 307, and 506 IPC. 4. Learned Assistant Government Pleader would submit that if there is any truth in the submission, the police would have informed the same to the concerned Magistrate Court while taking the husband of the petitioner into judicial custody. In the absence of such information, she cannot make out a case by filing some documents before this Court. 5. Learned counsel for the petitioner would submit that the petition may be disposed of, giving liberty to the petitioner to work out her remedies. 4 6. Considering the submissions made, this writ petition is disposed of. However, the petitioner is at liberty to work out the remedies before the appropriate forum according to law. There shall be no order as to costs.
