This is an application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for granting pre-arrest bail to the petitioners in connection with Sarthebari P.S. Case No. 51/2025, under Section 80/3(5) BNS, 2023. 3. The gist of the accusation as stated in the FIR dated 13.04.2025 is that the accused applicants subjected the daughter of the informant to physical and mental torture, as a result of which she committed suicide. 4. The learned counsel for the accused applicants submits that the main accused in the instant case, namely the husband of the deceased and the father-in-law of the deceased, have already been granted bail by a co-ordinate Bench of this Court. Vide order dated 02.06.2025, the accused applicants were granted interim protection, and in terms of the said order, they have already appeared before the Investigating Officer and had their statements recorded. He further submits that the accused applicants will cooperate with the investigation and make themselves available before the Investigating Officer as and when required. 5. Case Diary in the instant case has been produced before this Court and the same is perused. Page No.# 3/3
6. The learned Additional Public Prosecutor for the State of Assam, however, opposes the bail to the accused applicants at this stage. 7. Taking into consideration the entire facts of the case, as well as the bail orders of this Court and the interim order dated 02.06.2025, this Court is of the considered opinion that the interim order passed on 02.06.2025 should be made absolute. Accordingly, the same is made absolute on the same terms and conditions as stipulated in the order dated 02.06.2025. 8.
In view of the aforesaid, the instant AB application is disposed of. JUDGE Comparing Assistant
