Order 28/08/2025 In S.B. Criminal Miscellaneous (Petition) No. 3991/2025:
1. Heard counsel for petitioner, counsel for respondent No.2- complainant and learned Public Prosecutor.
2. The issue is in respect of declining permission to petitioner to go abroad during the period, i.e., 14.06.2025 to 30.06.2025 vide
[2025:RJ-JP:34319] (2 of 3) [CRLMP-3991/2025]
order dated 11.06.2025 passed by the Special Judge, Anti- Corruption Act No.1, Jaipur Metropolitan-II.
3. Having perused the impugned order dated 11.06.2025, it appears that the permission to the petitioner to go abroad has been declined only on the ground that in other criminal cases arising out of FIR Nos.404/2014, 406/2014, 407/2014 & 408/2014 ACB, Jaipur, criminal proceedings have been stayed by this Court. The application of petitioner has not been considered on merits as pleaded therein.
4. Counsel for petitioner, during course of argument do admits that the period for which the present application seeking permission to go abroad was moved, has expired, hence, if petitioner is permitted to move a fresh application, as and when he wants to go abroad, same may be ordered to be decided afresh by the trial Court without being influenced by the impugned order dated 11.06.2025.
5. In counter, the contention of counsel for complainant- respondent No.2 herein 'Shankar Lal Gurjar' is that if any fresh application is filed by petitioner, complainant should also be given a copy thereof and opportunity of hearing before passing any
order by the Court.
6. In view of above, since the impugned order dated 11.06.2025 pertains to declining the permission to petitioner to go abroad for the period from 14.06.2025 to 30.06.2025 and that period has expired, no fruitful purpose would be served to consider the order on merits. The prayer of counsel for petitioner seems to be genuine. Hence, without interfering with the impugned order dated 11.06.2025 on merits, the instant petition
[2025:RJ-JP:34319] (3 of 3) [CRLMP-3991/2025] is hereby disposed of with liberty to petitioner to file a fresh application, seeking permission to go abroad as and when he desires. In case, any such application is filed, the trial Court shall decide the same afresh without being influenced or prejudiced by the findings of order dated 11.06.2025. Needless to observe that copy of application shall be served upon the counsel for complainant as well and the order would be passed after extending opportunity of hearing to the counsel for complainant also.
7. Since S.B. Criminal Miscellaneous (Petition) No. 3991/2025 stands disposed of, Office to proceed to list the connected revision petitions in the regular roster and if necessary, may solicit instructions from Hon'ble the Chief Justice.
8. All pending application(s), if any, stand(s) disposed of.
