ORAL ORDER
Accused Nos.2 and 3 in Crime No.163/2024 registered by the Turuvanur (Jogi) Police Station, Chitradurga District, for the offences punishable under Sections 54, 103(1), 3(5) of BNS, 2023, are before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR was registered by the Turuvanur (Jogi) Police Station, Chitradurga District, for the offences punishable under Sections 54, 103(1), 3(5), of BNSS 2023, based on the first information dated 20.09.2025 received from Bomakka. 4. During the course of investigation petitioners herein who are arrayed as accused Nos.2 and 3, were arrested on 23.09.2024 and subsequently, remanded to judicial custody. After completing the investigation, charge sheet has been filed against four persons and petitioners are arrayed as accused Nos.2 and 3 in the charge sheet. - 3 -

Bail application filed by the petitioners before the jurisdictional Sessions Court in Cri.Misc.No.13/2025 and Cri.Misc.No.21/2025 were rejected vide order dated 21.01.2025. Therefore, they are before this court. 5. Learned counsel for the petitioners submits that the allegation against the petitioners herein and accused No.4 are similar in the charge sheet. The petitioner No.4 has granted anticipatory bail by this court in Crl.P.No.2287/2025. 6. Per contra, learned HCGP has opposed the petition, however does not dispute the submission made by the learned counsel for the petitioner. 7. A perusal of the material on record would go to show that the first informant is the wife of accused No.1-Manjunath. It appears that there was a dispute between the couple. First informant was staying in her parents house. Accused No.1 has requested his in-laws to send his wife to his house, but the first informant continued to stay in her parents house. It is in this background, accused No.1- Manjunatha came near the property of his in-laws on 19.09.2024 and had assaulted the deceased with machete and had committed their murder. Accused No.2 to 4 are the relatives of accused No.1 and allegation against them is that they had instigated accused No.1 to commit the murder of his in-laws. Undisputedly, accused Nos.2 to 4

were not present at the spot of crime on the alleged date of incident.
It is under these circumstances accused No.4 has granted regular bail by this Court in Crl.P.No.2287/2025. Therefore, the petitioners' prayer for grant of regular bail requires to be answered affirmatively on the ground of parity. Accordingly, the following:-
ORDER
The petition is allowed.
The petitioners are directed to be enlarged on bail in Crime No.163/2024 registered by Turuvanur (Jogi) Police Station, Chitradurga District for the offences punishable under Sections 54, 103(1), 3(5) of BNS, 2023, subject to the following conditions:-
a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons;
c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioners shall not involve in similar offences in future;

e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
