1 2025:CGHC:49307 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 3927 of 2023 1 - Mohammad Rafiq S/o Md. Gabbu Aged About 33 Years Posted As A Constable No. 093460125 Cisf Unit Bsp, Bhilai, District : Durg, Chhattisgarh. ... Petitioner(s) versus 1 - Union Of India Through The Home Ministry, Jaisingh Marg, Hanuman Road, Area, Cannought Place, New Delhi. 2 - Commandant Cisf Unit Bsp, Bhilai, District : Durg, Chhattisgarh ... Respondent(s) For Petitioner(s) : None. For Union of India : Mr. Ramakant Mishra, DSGI along with Ms. Shweta Rai, Advocate. Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 25/09/2025 1. By way of this petition, the petitioner has prayed for following reliefs:- RAGHVENDRA JAT Digitally signed by RAGHVENDRA JAT 2 “10.1 That this Hon'ble court may kindly be pleased to set aside memorandum dated 24/03/2023 passed by the respondent no 2. 10.2 That any other relief which this Hon'ble Court deems fit and proper may also be granted in favor of the petitioners safeguarding her interest.” 2. Learned counsel appearing on behalf of the Union of India respectfully submits that the petitioner has primarily sought to challenge the validity of the charge-sheet issued against him. However, it is pertinent to note that the departmental enquiry initiated pursuant to the charge-sheet has already been conducted in a thorough and comprehensive manner. Following the conclusion of the enquiry, the petitioner, who was found to be delinquent, has been duly subjected to disciplinary action culminating in his dismissal from service. Consequently, in light of the fact that the disciplinary process has reached its finality and the petitioner’s service has been terminated, it is submitted that the present petition has, therefore, become infructuous and devoid of any substantive purpose. 3. It has also been argued that a separate petition has already been submitted, wherein the order of dismissal issued by the respondent authorities is being formally challenged. 3 4. Accordingly, the present writ petition is dismissed as having become infructuous. SD/- (Amitendra Kishore Prasad) Judge Raghu Jat
