The Court made the following: 2 ORDER:- The learned counsel for the petitioner submits that the petitioner appeared pursuant to the order passed in Crl.M.P.No.4777 of 2021 in C.C.No.134 of 2021 by the learned Special Magistrate, Alamuru. The petitioner is facing trial for the alleged offence under Section 138 of Negotiable Instruments Act. 2. The learned counsel further submits that the petitioner intended to bring on record the certified copy of the plaint in O.S.No.1033 of 2023 and the written statement filed therein. The petitioner is the defendant in the said suit, which was filed by the nephew of the 1st respondent. 3. The learned counsel for the petitioner submits that the copy of the plaint and the written statement would amply clarify the stand of the petitioner in defending his case before the trial Court. It is submitted that there were several transactions between the petitioner and the 1st respondent and as such intended to mark the certified copy of the plaint and the written statement. It is submitted that the learned Magistrate dismissed the petition on the ground that the marking of the certified copy of the plaint and written statement in O.S.No.1033 of 2023 would be of no use to the petitioner/accused. The learned counsel for the petitioner fairly admits that the petition was filed at a belated stage, when the matter was posted for arguments. 3 4. Be that that as it may, the copy of plaint filed by the third party against the petitioner does not pertain to the subject cheque involved in the present criminal case. As such, this Court finds no valid grounds to interfere with the order of the learned Magistrate. 5. Accordingly, this Criminal Petition is dismissed.
