Neutral Citation No. - 2025:AHC:31626 Court No. - 49 Case :- WRIT - B No. - 822 of 2025 Petitioner :- Irfan Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Aditya Kumar Singh,Mohan Yadav Counsel for Respondent :- C.S.C.,Kaushal Kishore Mani,Pradeep Kumar Rai,Prajyot Rai Hon'ble Jayant Banerji,J. 1. Heard learned counsel for the petitioner and Shri P.K. Rai, learned counsel appearing for the respondent no. 4. 2. After decision in an appeal under sub-section (2) of Section 21, the revision preferred by the petitioner before the Deputy Director of Consolidation has been dismissed by the impugned order on the ground that necessary parties being the co-tenure holders of plot no. 63 were not impleaded. 3. Learned counsel for the petitioner has not been able to dispute the fact that the other co-tenure holders apart from the respondent no. 4 were necessary parties. 4. That being the case, the order cannot be faulted. At this stage, learned counsel for the petitioner requests permission to withdraw this petition as he would move an appropriate application before the Deputy Director of Consolidation for impleadment of necessary parties. 5. This petition is, therefore, dismissed as withdrawn. It shall be open to the petitioner to file such application before the Deputy Director of Consolidation as may be permissible under law at this stage of the proceedings. If such an application is filed, the same may be considered on its own merit without being influenced by any observation made in this order. Order Date :- 5.3.2025 A. V. Singh (Jayant Banerji, J.)
