JUSTICE SINDHU SHARMA, JUDGE ORDER 01.03.2025 Petitioners are allegedly involved in a case; FIR No. 59/2025 for the alleged commission of offences punishable under Sections 110/310/130/131/61/351/109 of BNS and 4/25 of Arms Act. The investigation culminated into filing of final report in terms of Section 173 Cr.PC, which is pending consideration in the Court of learned JMIC, Gandoh (for short “trial court”). Admittedly, proceedings in the trial court are at the stage of framing of charge. According to learned counsel for the petitioners no case is made out against the petitioners from a bare perusal of the final report. Since learned trial court is already seized of the matter and the case is at the stage of framing of charge, therefore, this petition is disposed of with a direction to learned trial Court to consider the pleas raised by the petitioners in the present petition in accordance with law and return a finding on charge/discharge of the petitioners as early as possible preferably within a period of one month from the date a copy of this order is made available to learned trial Court.
