[2025:RJ-JP:37443] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 8560/2025 Rajmal S/o Heerasingh, Aged 24 Years, R/o Village Jasouti, P.s. Pahari, District Deeg, Rajasthan. (Presently In Central Jail At Deeg, Bharatpur). ----Petitioner Versus State Of Rajsthan, Through Pp ----Respondent For Petitioner(s) : Mr. Arvind Sharma For Respondent(s) : Mr. Vijay Singh Yadav, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 15/09/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 173/2024 registered at Police Station Pahari, District Deeg for the offence(s) under Sections 143, 302, 323 and 341 of IPC. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that there is no specific allegation against the petitioner that petitioner caused fatal injuries to the deceased Bachu Singh. It is also contended that PW-1 Sachin, who is one of the injured, in his statement has stated that petitioner caused injury with the aid of axe to the deceased Bachu Singh at his head, however, in the cross-examination he has deposed that name of the petitioner Rajmal was mentioned on the basis of consultation with the other witnesses. The accused-petitioner is in custody since 11.06.2025 and the trial of the case may take [2025:RJ-JP:37443] (2 of 2) [CRLMB-8560/2025] considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the present accused-petitioner alongwith the other co-accused caused injuries to injured Parshuram, Sachin and Vishnu. The deceased Bachu Singh, received seven injuries which scummed him to death, the injury No. 1 was found to be at his scalp and incised wound was found in postmortem report. The other eye-witnesses Parshuram, Vishnu and Sachin, also sustained multiple injuries. Learned counsel further submits that independent witness Sahun has also corroborated the prosecution story and furthermore at the instance of petitioner axe was recovered, therefore, considering the above facts, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable for the court to express anything on the merits of the case. Considering the allegations levelled in the charge-sheet and specific statements of the injured witnesses Parshuram, Sachin and Vishnu, rendered under Section 161 Cr.P.C., this court is not inclined to enlarge the accused-petitioner on bail. 6. Accordingly, the present criminal misc. bail application filed by accused-petitioner is hereby dismissed. (PRAVEER BHATNAGAR),J ashu /83
