14/20.03.2025 The present writ petition has been filed for issuance of show cause to the respondent No.4 as to how and under what authority, the said respondent has not created Jamabandi in the name of the petitioner and has withheld issuance of rent receipt in his favour with respect to the land appertaining to Khata No. 07, Plot Nos. 3, 5, 15, 49, 53, 59, 67, 166, 167, 74, 86, 90, 93, 96, 100, 103, 115, 155, 165 & 63, Mouza-Chano, Thana No. 177, District-Hazaribagh, measuring an area of 15 Acres 54 Decimals. Further prayer has been made for issuance of direction upon the respondent No.4 to forthwith create Jamabandi in the name of the petitioner and issue rent receipt in his favour with respect to the said land.

Learned counsel for the applicants of I.A. No. 2212/2022 (interveners- Jagmohan Prasad & others) produces a copy of the order dated 18.06.2024 passed by a Bench of this Court in W.P.(C) No. 1763/2017 (Jagmohan Prasad Vs. The State of Jharkhand & Ors.) and submits that the said writ petition was filed by Jagmohan Prasad (one of the interveners of the present case) for quashing the order dated 08.11.2016 passed by the respondent No.3 in Misc. Case No. 5/2014-15 whereby the respondent No.4 was directed to open the Jamabandi in the name of the ‘Khatiyani Raiyat’ by cancelling the illegally
running Jamabandi and further to take action for issuance of rent receipt in favour of the ‘Khatiyani Raiyat’ with respect to the same land. The said writ petition was allowed vide order dated 18.06.2024 quashing and setting aside the order dated 08.11.2016 passed by the respondent No.3. Under the said circumstance, the prayer made in the present writ petition deserves to be dismissed.

Having heard learned counsel for the parties and considering that a writ petition being W.P.(C) No. 1763/2017 preferred by Jagmohan Prasad (one of the interveners of the present case) was allowed by a Bench of this Court vide the order dated 18.06.2024 quashing and setting aside the order dated 08.11.2016 passed by the respondent No.3 with respect to cancellation of the Jamabandi of the same land running in the name of Jagmohan Prasad and opening the same in the name of the ‘Khatiyani Raiyat’, I am of the view that the prayer made in the present writ petition is not worth consideration.
4. The present writ petition is accordingly dismissed.
5. Consequently, I.A. Nos. 2212/2022, 5640/2022 & 10814/2023 also stand
disposed of.
