Challenge in this writ petition is to impugned transfer order dated 15.05.2025 (Annexure P-1) whereby petitioner who is holding the post of 'Assistant Engineer', Sub-Division, Sendri under (O & M) Chhattisgarh State Power Distribution Com. Ltd., Bilaspur transferred to Assistant Engineer Sub-Division, Pathriya under (O & M) Division (for short ‘CSPDCL’ ), Mungeli (CG). 3. Learned counsel for petitioner submits that the petitioner is a victim of frequent transfer as on 2nd January, 2025 he was transferred from his previous posting at Sub- HIFZURRAHMAN ANSARI Digitally signed by HIFZURRAHMAN ANSARI Date: 2025.05.21 15:43:19 +0530 2 Division-Sakri, Bilaspur to the present place of posting and again within a short span of 5 months, he has been again transferred. Apart from this, he submits that only one post of Assistant Engineer is available at the transfer place, therefore, the impugned transfer order (Annexure P/1) is bad in law. 4. Learned State Counsel opposes submission and submits that transfer is an exigency of service and so far as only one post of Assistant Engineer is available at the transfer place, no pleadings has been made in this regard. 5. Heard learned counsel for the parties and perused record. 6. Be that as it may, on the basis of submission made by both the counsel for the parties, at this stage, without expressing any opinion onto the merits of the case, this writ petition is disposed of permitting the petitioner to make a detailed representation before the respondent Nos. 2 & 3/competent authority ventilating all his grievances as raised in this writ petition along with the copy of this petition within ‘7 working days’ from today and on submission of such representation the respondent Nos. 2 & 3/competent authority is directed to consider and decide the same within an outer limit of ‘15 days’ from the date of such representation in accordance with the relevant rules and law applicable to the case of petitioner along with the copy of this order, till the representation is decided, status quo with regard to the posting of the petitioner shall be maintained by the parties. 7. In view of above, I.A. No. 02/2025 application for urgent hearing and I.A. No. 3/2025 application for hearing during the summer vacation are also disposed of. 8.
