IN THE HIGH COURT OF JHARKHAND AT RANCHI First Appeal No. 210 of 2024 Ritesh Gautam --- --- Appellant Versus Swati Singh --- --- Respondent --- CORAM: Hon’ble Mr. Justice Rongon Mukhopadhyay Hon’ble Mr. Justice Arun Kumar Rai --- For the Appellant : Mr. Baibhaw Gahlaut, Adv. For the Respondent : Mr. Mukesh Kumar, Adv. I.A. No.10337 of 2024 05/03.01.2025 Heard Mr. Baibhaw Gahlaut, learned counsel for the appellant and Mr. Mukesh Kumar, learned counsel appearing for the respondent. This application has been preferred by the appellant for condoning the delay of 800 days in filing the appeal. The reason which has been assigned in the instant application seems to be with respect to the plethora of cases which have been filed between the parties. However, such reason does not seem germane for the purpose of condoning the inordinate delay of 800 days in filing the appeal. Counter affidavit has been filed by the respondent in I.A. No.10337 of 2024 in which also statements have been made with respect to the unexplainable delay of 800 days in filing the appeal. It has also been stated that with respect to the similar ground which has been taken in filing the suit for judicial separation, a suit for dissolution of marriage was also preferred which on being dismissed has led to preferring an appeal before this Court which is pending. On consideration of the averments made in the instant interlocutory application, we do not find any reasons to condone the delay of 800 days in filing the appeal and accordingly the same stands rejected. -2- Consequently, First Appeal No.210 of 2024 stands dismissed.
