JUSTICE PRAVEER BHATNAGAR Order 11/08/2025 1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No. 167/2025 registered at Police Station Bonli, District Sawai [2025:RJ-JP:31162] (2 of 3) [CRLMB-8556/2025] Madhopur for the offences under Sections 305(a) and 331(4) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the offences alleged against the accused- petitioners are exclusively triable by Magistrate. The accused- petitioners are in custody since 21.05.2025 and the trial of the case may take considerable time, there are no criminal antecedents against the accused-petitioner- Sanjiv Kumar, therefore, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed these bail applications and contended that against the accused- petitioner- Gajendra, 6 similar nature of cases were registered from the year 2023-2025. The petitioner- Gajendra is a habitual offender. It is also contended that the petitioners committed theft in a temple and theft articles were recovered from their instance, therefore, the bail applications of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. Considering the fact that the offences alleged against the accused-petitioners are exclusively triable by Magistrate, the accused-petitioners are in custody since 21.05.2025 and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: [2025:RJ-JP:31162] (3 of 3) [CRLMB-8556/2025] 1. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
