Heard the parties.
The petitioners have been made accused in connection with Satgawan P.S. Case No. 92 of 2024, corresponding to G.R. Case No.449 of 2025, for the offence under Sections 274, 275 & 3(5) of the B.N.S., 2023 and Section 47(a) of Excise Act, pending in the court of Miss Jyotsana Pandey, learned Judicial Magistrate, 1st class, Koderma.
On 23.10.2024, Satgawan Police on the basis of confidential information raided a place near Jamuniyatanr forest area and seized 615 liters of illicit country made liquors from there.
It was submitted that petitioners were neither arrested at the spot nor anything was recovered from their possession. It was further submitted that co-accused Vijay Roy @ Vijay Singh and Peyari Rai have been granted bail by this Court in B.A. No.7593/2025 and the case of the petitioners stands on similar footing.
In view of the submission made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of Miss Jyotsana Pandey, learned Judicial Magistrate, 1st class, Koderma, or her successor, in connection with Satgawan P.S. Case No. 92 of 2024, corresponding to G.R. Case No.449 of 2025.
