The petitioner has filed this petition with the following prayers:- “10.1 The Hon’ble Court may kindly be pleased to issue such writ/order/direction revoking the illegal counter offer and price matching benefit made by Respondent No.2 to Respondent No.3; and 10.2 The Hon’ble Court may kindly be pleased to issue such writ/orders/direction directing the Respondent No.2 to act lawfully and award the contract to the Petitioner; and 10.3 The Hon’ble Curt may kindly be pleased to issue an appropriate writ/order quashing the Letter of Award in favour of the Respondent No.3, in case the Letter of Award has been issued and 10.4 Cost of the petition may also be granted to the Petitioner; and 10.5 Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.” 3. Admittedly, learned counsel for the petitioner submits that the representation of the petitioner has already been rejected by the respondent authorities vide order dated 15.05.2025 and the said order has not been challenged in the present writ petition, as such, he may be permitted to withdraw this writ petition with liberty to file afresh challenging the order dated 15.05.2025, whereby the representation filed by the petitioner has been rejected. 3 4. Learned counsel appearing for the respondent-SECL has no objection. 5. Considering the facts in its entirety, particularly the fact that petitioner has not challenged the order dated 15.05.2025 whereby his representation has been rejected, instant petition is liable to be dismissed as withdrawn with the aforesaid liberty granted in favour of the petitioner.
