The petitioner has been made accused in connection with Itkhori P.S. Case No.16 of 2024, for the offences registered under Sections 147, 149, 341, 323, 307, 452 & 302 of the Indian Penal Code, subsequently Section 302 of the I.P.C. was added, pending in the court of learned Additional Chief Judicial Magistrate, Chatra. 3. On 17.02.2024, the petitioner along with co-accused persons are alleged to have assaulted the brother of the informant due to which he sustained injury on his head. Later on, he succumbed to his injuries. 4. The informant in his restatement has specifically stated that co- accused Jitendra Giri and Deepak Giri have assaulted his brother Mithlesh Dangi by rod on his head. 5. It was submitted that there is no allegation against the petitioner of having assaulted the deceased. It was further submitted that co-accused has been granted bail by this court and the case of the petitioner stands on similar footing. 6. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Itkhori P.S.
