1. Heard on admission.
2. The petitioner has filed this petition seeking the following reliefs:
“10.1 That this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to release payment of Rs. 9,64,849/- to the petitioner forthwith towards Digitally signed by SMT NIRMALA RAO
-2- construction of Sanskritik Manch at Village Buchipur, with interest @ 12% per annum from the date of its become due to its actual payment. 10.2 That any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the cost of the petition may be given.”
3. The reply filed by respondent No.2 would show that due to non- allocation of funds in the financial year 2018-19 by the State Government, the amount payable to the petitioner could not be released. Respondent No.2 through letters dated 8.8.2018, 21.8.2018, 5.11.2018 & 31.12.2019 has sought the allotment of funds from the State and also communicated to the petitioner that the balance amount would be paid immediately after receiving the funds from the State Government.
4. Taking into consideration the return filed by respondent No.2, this petition at this juncture, is disposed of directing respondent No.2 to make payment of the balance amount to the petitioner at the earliest.
5. Accordingly, the petition is disposed of at motion stage itself. Sd/-
