02/ 25.08.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Chainpur P.S. Case No. 21 of 2025, registered under sections 317(5)/3 (5) of BNS, 2023 and under section 12 (1) of Jharkhand Bovine Animal Slaughter Act, 2005 and under section 11 (1) (2) of Animal Cruelty Act, 1960, pending in the Court of learned Judicial Magistrate, Ist Class, Gumla.

Learned counsel for the petitioner submits that petitioner is owner-cum-driver of pick-up van and allegations are made that in the said vehicle bovine animals were being carried out. He submits that petitioner has no criminal antecedent which is disclosed in para 10 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that petitioner is owner-cum-driver of the said vehicle in which bovine animals were being carried out.

It appears that in identical situation in A.B.A. No. 4297 of 2025 the co-accused has been directed to surrender before the learned court and on his surrender the learned court was directed to release him on bail and in

view of that the same order is being passed. Accordingly, the petitioner is
directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned court will release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
