A The Court made the following ORDER: The CrI'minaI Petition has been filed under section 482 of BharatI-ya Nagarik Suraksha sanhita, 2023 (for brevity c{he BNSSJ), by the petitioner for -I-granting of pre-arrest bail in connection with crime No.226 of 2025 of proddaturhRuraI Police Station, Kadapa District, registered for the alleged offences punishable under sections 308 (5), 351 (2) read with 3 (5) of Bharatiya Nyaya Sanhi{ha, 2023 (for brevity fthe BSS'). 2. Facts, I-n brief, of the case of the prosecution are that Accused Mos.1 and 2 are husband and wife and they met the de-facto complainant and convinced him that they will use his scorpio car for hire for pooja International School activities by paying monthly instalments. Accused Nos.1 and 2 failed to pay the monthly instalments and they received court notices for not paying the loan. On 16.04.2025, the de-facto complainant ~along with his close associates went to Pooja International school and asked the accused to return his car, but the accused did not return the car.
whI-le the COmPlainant was taking his car, accused Nos.1 and 2 forcl-bly took hl-m out of his car and extorted the car from complainant and also threatened him with dire COnSequerlCeS. Hence, a case was registered. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 4. Smt. R. Sudha Rani, learned counsel for the petitioner submits that the \-. -= Petitioner has not committed -any offence and she was falsely implicated in this case. The petitioner would abide by any condition to be imposed by this court. rF>-.i®
5. I Percor7fra, Ms. P. Akila Naidu, the learned Assistant Public prosecutor, opposed in granting of bail stating that some more material witn`esses' have' toll be examined; investigation is not comp'leted; if the petitioner is enlarged on pre-arrest bail, he would not be available for the investigation and he would escape from the clutches of law and urged to dismiss the bail `petition. 6. As seen from the record, the petitioner is a female, aged' about 35 years. The petitioner is wife of the Dean of Pooja International School who i-s figured as Accused No,1 and as per the version of the prosecution, the petitioner is working as a teacher in the same school. The de-facto complainant made his vehicle (scorpio) for the transportation services to the husband of petitioner to pooja International School on hire basis. As th`e husband of the petitioner had not paid the instalments,J notices were sent to the de-facto complainant in whose name the vehicle is registered`, Therefore, the de-facto complainan{ went to the petitioner and her husband for collecting ' the instalment. As the petitioner and her husband did not give the instalments money to the de-facto complainant, the de-facto complainant tried to take away the Scorpio vehicle from the possession of the petitioner. In t'his case, the husband of the petitioner was arrested and enlarged on regular bail. Now,h the Scorpio vehicle has come to the possessI'On Of the de-faCtO COmPIainant. 7.
Considering the entire case of the prosecution, the alleged role played by the petitioner and nature of allegations levelled against the petitI-Oner Who has got a fixed abode in Bakarapuram, Pulivendula, Kadapa DistrI'Ct, this rf---------i=
