THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.G.PANDIT - 3 - NC: 2025:KHC:2308 WP No. 10188 of 2023 ORAL ORDER The petitioner, working as Constable in the 2nd respondent-Central Industrial Security Force (CISF) is before this Court under Article 226 of the Constitution of India, questioning the order bearing No.E- 38014/(03)/PS/Karmik/2023/607 dated 01.04.2023 (Annexure-A) and Communication/Office Memorandum dated 12.04.2023 bearing No.E-37017/CISF/URSC(B)/ADM- I/POSTING/2023-2719 (Annexure-B), by which the petitioner was transferred from Bengaluru to 1st Reserve Battalion Barwaha, Madhya Pradesh. 2. Heard Sri. H.S.Prashanth, learned counsel for the petitioner and Sri. Shanthi Bhushan.H., learned DSGI for respondent Nos.1 to 4. Perused the writ petition papers. 3. Learned counsel for the petitioner would submit that the petitioner in view of the fact of ill-health of her parents and as her daughter is studying in 12th Standard at Bengaluru, requested to continue her at Bengaluru. Further, learned counsel for the petitioner would submit that the husband of the - 4 - NC: 2025:KHC:2308 WP No. 10188 of 2023 petitioner who was working in CISF, took voluntary retirement who was also earlier transferred to Barwaha. 4. Learned DSGI, Sri. Shanthi Bhushan.H., places on record Circular No.07/2024 dated 23.12.2024 Guidelines for Posting/Transfer of NGOs. In terms of Clause-5(d) of Circular No.07/2024 dated 23.12.2024, the Authorities would consider the request of the petitioner and pass an appropriate order. 5. Learned counsel for the petitioner would submit that the petitioner also intends to take voluntary retirement and would submit representation accordingly. Learned counsel for the petitioner further submits that the petitioner would submit representation within two days seeking continuation of her services in Bengaluru on the ground that her daughter is studying in 12th Standard. 6. In light of the above, following: ORDER (a) The petitioner is granted two days time to submit representation seeking continuation of her services at Bengaluru. If such representation is submitted, the respondents are directed to consider the request of the petitioner in light of Clause-5(d) of - 5 - NC: 2025:KHC:2308 WP No. 10188 of 2023 Circular No.07/2024 dated 23.12.2024 and pass an appropriate order. (b) Interim order granted by this Court on 16.05.2023 is continued till 30.04.2025 or till order is passed. (c) With the above, writ petition stands disposed off.
