Order 28/07/2025
1. These bail applications under Section 483 of BNSS have been filed on behalf of the petitioners, who have been arrested in connection with FIR No.226/2024 registered at Police Station Sadar Jaipur, District Jaipur (West) for the offences punishable under Sections 384, 406, 416, 419, 420, 467, 468, 471, 506 & 120B of IPC. After completion of investigation, police filed charge- sheet in this matter for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B of IPC.
2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated. Counsel submit that petitioners are innocent and they have not committed any offence. It is submitted that alleged offences are triable by Magistrate. It is submitted that trial will take considerable time in its conclusion. Counsel submit that petitioners are in custody since 03.10.2024, 21.01.2025, 12.02.2025 & 21.01.2025, respectively and further custody of the petitioners would not serve any fruitful purpose.
3. Learned Public Prosecutor assisted by learned counsel for complainant vehemently opposes the submissions made by
learned counsel for the petitioners. It is submitted that similarly situated co-accused persons namely- Pooja, Shankar Lal Sharma, Bhanwar Lal Sharma & Ramavtar have been denied benefit of bail by the Co-ordinate bench of this court after considering the fact that they are involved in conspiracy and have caused huge loss of
[2025:RJ-JP:28174] (3 of 3) [CRLMB-5300/2025] Rs.86,70,000/- to the complainant and deceitfully sold the property of Mohan Lal and Bhuri Devi.
4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced at bar, especially the fact that similarly situated co-accused persons have already been denied benefit of bail by the Co-ordinate bench of this court, as also considering the manner in which offence has been committed thus, looking to the nature and gravity of offence this court is not inclined to enlarge the petitioners on bail.
5. Accordingly, these bail applications are dismissed.
6. The observations made hereinabove are only for decision of the instant bail applications and would not have any impact on the trial of the case in any manner.
7. However, petitioners would be at liberty to renew the prayer for bail before the learned trial court under Section 480(6) of BNSS (Corresponding to Section 437(6) of Cr.PC).
