THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL REVISION CASE No.744 of 2024 ORDER: This Criminal Revision Case has been filed to set-aside the docket order dated 18.12.2023, passed in STC.No.8 of 2022 on the file of the Additional Judicial Magistrate of First Class, Hindupur, Ananthapur District. 2. Heard the learned counsel for the petitioner. 3. The petitioner is the accused in S.T.C.No.8 of 2022 on the file of the learned Additional Judicial Magistrate of First Class, Hindupur. A private complaint has been filed by 2nd respondent/ complainant for the offence under Section 138 of the N.I.Act as against the petitioner herein. Pending the complaint, the said S.T.C. has been transferred to Lok Adalat for compromise. But, the matter was not settled in Lok Adalat and referred back to the regular Court. On 08.12.2023, as the petitioner/accused was not present before the Court below, the matter was posted to 16.12.2023. From 16.12.2023, the matter was posted to 18.12.2023, and on 18.12.2023 also, as the petitioner/accused was absent, the learned Magistrate issued NBW against the accused. 2 4. The learned counsel for the petitioner submits that the petitioner underwent heart surgery, and due to the said reason, he could not attend Court below. He further submits that the petitioner is ready to attend the Court below without fail. 5. In view of the said reason, the petitioner shall make an application before the jurisdictional Magistrate and on such application, the learned Magistrate is directed to dispose of the said application by recalling the Non-Bailable Warrants issued against the petitioner, on such terms and conditions as it deems fit and proper. 6. Accordingly, the Criminal Revision Case is disposed of. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Revision Case shall stand closed. _______________________ K.
