[1] Heard Mr. Th. Jugindro, learned counsel for the petitioner along with Ms. Kh. Rupashree, learned counsel on behalf of the petitioner and Mr. Y. Ashang, learned PP assisted by Mrs. R.K. Emily, learned Dy. Government Advocate on behalf of the State respondent. [2] The petitioner approached this Court under Section 439 of Cr.PC for releasing him on bail in connection with FIR No. 58(7) 2017 BPR-PS u/s 302/364/365/120-B/34 of IPC. Charge was framed against all the 4 accused persons under section 302/34 IPC. It is submitted that the main accused, Ningthoujam Tomcha Singh, was released by the Court of Sessions Judge, Bishnupur vide order dated 07-11-2022 in Cril. Misc. (B) Case No. 57 of 2022, the other co-accused, Hemam (N) Moirangthem (O) Indira Devi was released by the Court of Chief Judicial Magistrate, Bishnupur vide order dated 06-11-2017 in Cril. Misc. (B) Case No. 137 of 2017 and the 3rd accused, one Ningthoujam Julon @ Jitenkumar Singh, was released by this Court vide order dated 20-03-2025 in Bail Application No. 27 of 2024. [3] Mr. Y. Ashang, learned PP for the State respondent, has clarified that the main accused, N. Tomcha Singh, was released on bail on medical ground. [4] Mr. Th. Jugindro, learned counsel for the petitioner, submits that as per the prosecution story, the petitioner is involved in conspiracy of committing murder and it is submitted that the petitioner has no direct involvement in the actual murder of the victim. By the impugned order dated 05-01-2024 passed by the learned Sessions Judge Bishnupur in Cril. Misc. (B) Case No. 54 of 2023, even after recording the facts of release of other co-accused on bail, the petitioner’s bail application was rejected due to the serious nature of offence. Mr. Th.
Jugindro, learned senior counsel for the petitioner, submits that the petitioner may be released on bail on parity with other co-accused with the conditions as may be imposed by this Court. [5] Mr. Y. Ashang, learned PP, has clarified that the petitioner is also involved in the murder of the victim. However, the learned PP clearly admits that out of the 4 accused, 3 co-accused have already been released on bail by the Trial Court as well as by this Court. [6] This Court has considered the material on record. No doubt, the offence under Section 302 read with 34 IPC is a serious one and that also committed in terms of the conspiracy among the accused. In the order dated 03-12-2025, this Court has noted the fact that out of the 4 accused, 3 co- accused have already been released on bail and out of the 41 witnesses cited, only 16 witnesses have been recorded so far and the trial will take considerable time. Without going into the merit on the accusation made against the petitioner herein, this Court is inclined to release the petitioner

on bail to the satisfaction of the learned Sessions Judge, Bishnupur. The petitioner shall be released on bail with the following conditions:— i. The petitioner be released on bail on his furnishing PR bond of Rs. 2,00,000/- (Rupees two lakh) only along with 2 (two) sureties for a like amount to the satisfaction of the Trial Court. The petitioner shall also furnish immovable property security to the satisfaction of the Trial Court. ii. The petitioner shall deposit his passport, if he possesses one, before the Trial Court and shall not leave the State of Manipur without the permission of the Trial Court. iii. The petitioner shall appear before the Trial Court on every date fixed by the Trial Court and on such date as specifically
directed. [7] If the petitioner violates any of the conditions given hereinabove, the respondent is at liberty to approach this Court for passing an appropriate
order. [8] With this observation, the bail application is allowed. [9] Send a copy of this order to the learned Sessions Judge, Bishnupur for doing needful.
