Order No.02 Dated- 29.08.2025
Heard the parties.
The petitioners have moved this Court for grant of bail in connection with Meral P.S. Case No. 35 of 2025, corresponding to Sessions Trial No. 161 of 2025 registered for the offences punishable under sections 103(1) & 85 r/w Section 3(5) of the B.N.S., 2023 and under Section 3/4 of the Dowry Prohibition Act.
The learned counsel for the petitioners submits that this is the second journey of the petitioners with the prayer for regular bail. It is next submitted by the learned counsel for the petitioners that the fresh ground is that after rejection of the earlier bail application vide order dated 12.06.2025 in B.A. No. 4049 of 2025, two witnesses who are respectively, the son and daughter of the deceased, have been examined and they have categorically stated that the petitioners have no role in the death of the deceased. It is further submitted that the allegations against the petitioners are all false. It is next submitted that the petitioners have been in custody since 16.02.2025, as has been mentioned in paragraph no. 01 of the bail application. It is further submitted that the petitioner undertakes to cooperate with the trial of the case. Hence, it is submitted that the petitioners be admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioners on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Garhwa, in connection with Meral P.S. Case No. 35 of 2025, corresponding to Sessions Trial No. 161 of 2025 with the condition that the petitioners will co-operate with the trial of the case and will furnish their mobile number and photocopy of the Aadhar Card with an undertaking that they will not change their mobile number during the trial of the case.
