The petitioner is before this Court seeking regular bail in S.C No.5/2024 (Crime No.84/2023 of the respondent - police) pending on the file of III Additional District and Sessions Judge at Mangaluru. Factual matrix of the case: 2. It is the case of the prosecution that, Smt.Vasanthi Shetty is a resident of Bellayuru Village residing along with her husband. On 17.09.2023, she had been to medical stores to bring the medicines. After returning to her home, an unknown person came to her house and requested her to give an empty bottle to get the petrol filled. Again, around 12.30 p.m., the said person came to the house and requested her that he wanted a small bottle instead of big bottle. When the complainant tried to go inside the house to bring the bottle, two persons were standing in the side, immediately, showed the - 3 - NC: 2025:KHC:18311 CRL.P No. 5241 of 2025 knife and took her 40 grams gold chain along with Karimani sara. Thereafter, they went away from the spot. 3. After the incident, she lodges a complaint before the respondent - police in respect of the incident. The respondent - police registered a case in Crime No.84/2023. After conducting investigation, submitted the charge sheet. 4. Heard Sri.V.B.Siddaramaiah, learned counsel for the petitioner and Sri.Vinay Mahadevaiah, learned HCGP for the respondent – State. 5. It is the submission of the learned counsel for the petitioner that the petitioner is innocent of the alleged offences. They are in need of medical assistance. The examination of material witnesses is over. They may be enlarged on bail by imposing suitable conditions. Making such submissions, the learned counsel for the petitioner prays to allow the petition. 6. Per contra, the learned High Court Government Pleader for the respondent - State submitted that this is a successive bail application. In earlier round of litigation, the same relief was sought by the petitioner and it has been rejected. Therefore, it is not appropriate to grant any relief as - 4 - NC: 2025:KHC:18311 CRL.P No. 5241 of 2025 prayed for till examination of all the witnesses. Making such submissions, the learned HCGP prays to dismiss the petition. 7. Heard the learned counsel for the respective parties and also perused the order of the Co-ordinate Bench relating to rejecting the bail petition of the petitioner. After having gone through the facts and circumstances of the case, I am of the considered opinion that it is not a fit case to grant bail. 8. Hence, I proceed to pass the following: ORDER The petition is rejected. However, it is directed the Trial Court to expedite the trial and complete the same within a period of six weeks from the date of receipt of certified copy of this order.
