Heard Mr.H.S.Paonam, learned senior counsel assisted by Mr.S.Gunabanta, learned counsel for the petitioner, Mr.Y.Ashang, learned Government Advocate assisted by Ms.R.K.Emily, learned Dy.GA for the State respondent and Mr.S.Jasobanta, learned counsel for respondent No.5/Principal Accountant General, Manipur. The petitioner has approached this Court for a direction to the respondents for releasing advance GPF amount of rupees eight lakhs in terms of application dated 20.08.2025 for meeting the expenses for marriage of his son scheduled to be held on 5.12.2025. The prayer in the writ petition is reproduced below:

ii) issue an appropriate writ of mandamus or any other appropriate writ/ directions for allowing the petitioner to withdraw/ for releasing the entitled advance GPF amount of Rs.8 lakhs in terms of the Application dated 20.08.2025 as the same is permissible as per law/ Act/ Rules advance to meet expenses relating to marriage of his son scheduled for
5.12.2025. iii) ……”
Mr.H.S.Paonam, learned senior counsel for the petitioner submits that in terms of Rule 15 (A) (b) of the GPF Act, 1925 and GPF Rules, a government employee can withdraw advance from the GPF amount accumulated in his favour on completion of certain criteria, such as marriage of children, construction of house etc. It is submitted that the present application is for marriage of son of the petitioner. Hence, advance withdrawal is permissible as per Rule 15 (A) (b) as mentioned above. Mr.Y.Ashang, learned Government Advocate submits that subject to the conditions specified, withdrawals may be sanctioned by the authorities competent to sanction an advance for special reasons as per Rule. Mr.S.Jasobanta, learned counsel for respondent No.5 submits that necessary order can be issued only after submission of required documents from the Administrative Department. In such situation, the Administrative Department is directed to forward necessary papers to the office of the Principal Accountant General, Manipur, if the petitioner is eligible, within a period of two weeks and the office of the Accountant General, Manipur shall pass appropriate order within a further period of one week from the date of receipt of the necessary documents from the Administrative Department. With this observation, the writ petition is disposed of.
