This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner, namely Ruhit Gupta @ Rohit Kumar Gupta, apprehending arrest in connection with Bokajan P.S. Case No. Page No.# 2/2 51/2025 registered under Sections 316(3)/318(4)/ 61(2)(a) of BNS, 2023. The learned counsel for the petitioner has submitted that the petitioner is a 21 year old boy working in his father’s grocery shop and occasionally arranges trucks for transportation of goods when contacted by different persons and he is not involved with the alleged offence. It is also submitted that the petitioner has appeared before the police earlier in this regard. The learned Addl. P.P. has submitted that the case diary does not reflect any appearance by the petitioner before the police. Moreover, there are sufficient materials available in the case implicating the present petitioner in the alleged offence and the stolen goods have not yet been recovered. Having regard to the above, custodial interrogation of the petitioner may be necessary. Consequently, the prayer for bail stands rejected at this stage. The bail application stands dismissed.
