03/ 27.08.2025: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Sarath P.S. Case No. 42 of 2025, registered under sections 126(2), 115 (2), 117(2), 109(2), 132, 352, 351(2), 3 (5) of BNS, 2023, pending in the Court of learned Judicial Magistrate, Ist Class, Madhupur.

Learned counsel for the petitioners submits that there is general and omnibus allegation against the petitioners and all the family members have been implicated in this case and even ladies members have not been spared and the petitioners are ladies. He submits that police has reached to the house of the petitioners in search of cyber criminal namely, Suman Kumar who was not present in their house and in view of that false allegation has been made. He submits that petitioners have no criminal antecedent which is disclosed in para 12 of the petition and injury is simple in nature. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that altercation took place and injury has been received.

Considering that entire family members have been made accused, petitioners are ladies having no criminal antecedent which is disclosed in para 12 of the petition and there is general and omnibus allegation, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Madhupur, in connection with Sarath P.S. Case No. 42 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
