[2025:RJ-JP:9845] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 8052/2024 1. Kuldeep Singh S/o Shri Rampal Singh, Aged About 66 Years, R/o House No. 93 Village Nagla Kashi Post Saamna Dholana (Hapur) Uttar Pradesh. 2. Dushyant Kumar S/o Sharwan Singh, R/o Village Nagla Kashi Post Saamna Dholana (Hapur) Uttar Pradesh. ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Chandra Mohan Sharma Mr. V.D. Agnihotri For Respondent(s) : Mr. M.S. Shekhawat, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 05/03/2025 1. The instant pre-arrest bail application has been filed under Section 438 of Cr.PC filed on behalf of the petitioners, who are having apprehension of arrest in F.I.R. No.231/2016 registered at Police Station Jalupura, District Jaipur (Rajasthan) for offences under Sections 420, 406 & 120B of IPC. Later on, police filed charge-sheet in this matter. 2. It is contended by learned counsel for the petitioners that accused-petitioners have falsely been implicated in this case. Counsel submits that neither petitioners are named in the FIR nor they were/are holding any position in the company who is the co- accused of this case. Counsel submits that police wants to arrest the petitioners only on the basis of the fact that it has come out in [2025:RJ-JP:9845] (2 of 3) [CRLMB-8052/2024] the investigation that petitioners are related to the accused- company. Counsel submits that vague allegations cannot be the basis of arrest of the petitioners. Counsel submits that in identical matter facility of pre-arrest bail has been granted to the petitioners by co-ordinate Bench of this Court. Custodial interrogation of the petitioners would not serve any fruitful purpose. 3. Learned State Counsel opposes the submissions made by counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by counsel for the petitioners, as also the fact that petitioners are not named in the FIR; considering the material available on record, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. The anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Jalupura, District Jaipur (Rajasthan) in F.I.R. No. 231/2016 is directed that in the event of arrest of the petitioners- (1) Kuldeep Singh S/o Shri Rampal Singh & (2) Dushyant Kumar S/o Sharwan Singh, they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- [2025:RJ-JP:9845] (3 of 3) [CRLMB-8052/2024] (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioners shall not leave India without previous permission of the court.
