ORDER: Heard Sri T. Janardhan Rao, learned counsel for petitioner, learned Government Pleader for Services-I for respondent Nos.1 to 3 and Sri Gudapati Lakshmi Narayana, learned Standing Counsel for respondent No.5. Petitioner assails the action of 5*'^ respondent-Municipality in not allowing her to attend to duties as Non-Public Health Worker
2. (Outsourcing Worker), despite having rendered 16 years and 8 months of service, without any prior notice or enquiry, as illegal and arbitrary. Petitioner has been engaged by 5*'^ respondent as Non-Public Health Worker on outsourcing basis with a consolidated salary and came to be appointed on 01.09.2008. She has been posted to work in Births & Deaths Registration Section and since then, she has
3. been discharging duties entrusted to her in the said Section. It is stated that she is not being allowed to attend to duties with effect from 10.04.2025, without any reason or notice. Representations dated 16.04.2025 and 19.05.2025 have been made to 5"^ respondent, requesting to permit her to attend to duties, which are stated to be pending. Learned Standing Counsel for 5*^ respondent has placed on record written instructions dated 08.07.2025 inter alia stating that as

CGR.J W.P.No.16647 of 2025 certain complaints were received against petitioner’s behavior while dealing with public in discharge of her duties in Births & Deaths Registration Section, in order to mitigate the inconvenience and administrative reasons, she was directed to work in Engineering Section. However, petitioner chose not to attend to duties and insisted the authorities to retain her in Births & Deaths Registration Section. Since petitioner is voluntarily abstaining from duty, she cannot claim that respondent is obstructing her to attend to duties. on

Learned counsel for petitioner, however, tried to dispute the aforesaid written instructions.
6. It appears, the petitioner has been in service, though on outsourcing basis, for the last more than sixteen years. It is not the case of 5'^ respondent that they have taken any steps to disengage her from service or prevent her from discharging duties. Rather, she was only shifted from one section to another section administrative reasons. The petitioner cannot insist authorities to continue her in Births & Deaths Registration Section, as she has no such right for continuation there and is, in fact, bound by the instructions of 5*'^ respondent to work in any other section. on
7. As learned counsel for petitioner submits that petitioner is willing to move to Engineering Section and that 5*^ respondent has
5 CGR,J W.P.No.16647 of2025 also stated that they have neither disengaged her from prevented her from attending to duties in Engineering Section, recording the aforesaid statements, the Writ Petition is disposed of by directing 5*^ respondent to allow the petitioner to attend to duties in Engineering Section. There shall be no order as to costs. service nor As a sequel, miscellaneous petitions, pending if any, shall stand closed.
