The learned counsel for the petitioner submits that the petitioner is arraigned as Accused No.2 in Crime No.43 of 2024 for the alleged offence under Sections 11(1)(a)(d) of the Prevention of Cruelty to Animals Act, 1960. The petitioner filed CrI.M.P. No.80 of 2024 before the Judicial First Class Magistrate, Gooty, seeking interim custody of the cattle seized from his possession while they were being transported. The learned Magistrate dismissed the said petition. Thereafter, the petitioner preferred a revision before the VI Additional Sessions Judge, Gooty, and the same was also dismissed. It is submitted that the petitioner is the owner of the cattle and was transporting them for the purpose of resale to farmers. 2. This Court is of the considered view that unless and until the Station House Officer verifies the antecedents of the petitioner and the purpose of transporting the cattle, custody ought not to be given to the petitioner. The Station House Officer has sent the cattle to the Gosala, where they are being properly taken care of. It is also submitted that the police have completed the investigation and found that the cattle were being transported for slaughter. In these circumstances, this Court is not inclined to interfere. 3. 4. Accordingly, this Criminal Petition is dismissed. 3 V > As a sequel, pending miscellaneous petitions, if any, shall stand closed.
