The writ petition has been filed praying for quashing the F.I.R. dated 26.01.2025 giving rise to Case Crime No. 0014 of 2025, under Sections 420, 467, 468, 471 IPC at Police Station- Civil Lines, District- Meerut, against the petitioners and for a direction to respondents not to arrest the petitioners pursuant to the aforesaid F.I.R. 3. From the First Information Report, it appears that there is a complex civil dispute between the parties. Suit has already been instituted by the petitioners in this regard and in the meantime, F.I.R. has also been lodged by respondent No.3 against them. It is submitted that police is investigating the allegations made in the F.I.R. 4. Learned AGA as well as learned counsel appearing for respondent No.3 have opposed the submissions made by learned counsel for the petitioners. 5. In the totality of facts and circumstances and for the reasons given in the order dated 10.7.2024 passed in Criminal Misc. Writ Petition No.7463 of 2024 (Shobit Nehra and another vs. State of UP and others), this writ petition is disposed of directing that till the cognizance is taken on the police report under Section 173(2) Cr.P.C./193(3) B.N.S.S., by the court below, the respondents are restrained from arresting the petitioners pursuant to the impugned First Information Report, subject to their cooperation in the ongoing investigation.
