THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 14960 OF 2018 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “….to issue a Writ Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent 2 to 5 in selecting 6th respondent as Anganwadi Worker vide proceedings vide No.128/A1/2017 dated 23.01.2018 is illegal arbitrary and violation of principles of natural justice and consequently set aside the same and pass….” 2. Heard Sri C.Prakash, learned counsel for the petitioner and learned Assistant Government Pleader for Child Welfare and Women Development. 3. Learned counsel for the petitioner would submit that, due to the change in the political scenario, although the petitioner obtained the highest marks in the 10th class, which were more meritorious than those of the unofficial respondent No. 6, she was denied the post of Anganwadi Worker. Learned counsel would submit that several representations were made to the District Collector and Project Director, ICDS, but these representations were not considered. Learned counsel would further submit that a great deal of injustice has been done to the petitioner, as the highest marks were awarded to respondent No. 6 in the interview. 2 4. Learned Assistant Government Pleader would submit that it is not the case of the petitioner that the respondent authorities have violated any rules or laws. The petitioner's case is that she was denied the post of Anganwadi Worker in the interview. Learned Assistant Government Pleader would submit that the respondent authorities have followed G.O.M.S. No. 18, dated 15.05.2015, and that in the interview, respondent No. 6 secured higher marks than the petitioner, which is why respondent No. 6 was selected for the post of Anganwadi Worker. No material has been placed on record to show any bias on the part of the respondent authorities. Learned Assistant Government Pleader would submit that the Writ Petition may be dismissed. 5. Considering the submissions made and a fair look at the material placed on record, as rightly pointed out by the learned Assistant Government Pleader, the respondent authorities have followed G.O.Ms.No.18, dated 15.05.2015, for the selection of the Anganwadi Worker. The record further shows that the petitioner secured 63 marks, whereas respondent No. 6 secured 66 marks. Therefore, the petitioner did not secure higher marks than respondent No. 6. There is no dispute about the fact that the petitioner was highly meritorious when compared to the marks in the SSC examination. However, in light of G.O.M.S.No.18 dated 15.05.2015, with respect to the marks secured in the 10th class, one has to get 50 marks, and the 3 other categories are mentioned in the G.O. It is pertinent to extract the relevant portion of G.O.M.S.No.18 dated 15.05.2015 as follows: Sl.No. Parameters Marks 1. Marks secured in X class examination 50 2. In the light of the aforementioned premises, as respondent authorities have followed the G.O.Ms.No.18 dated 15.05.2015, while selecting the candidate as Anganwadi Worker, nothing is there to interfere in the matter. In the result, this Writ Petition is dismissed. There shall be no order as to costs.
