The petitioner is challenging an order passed by the Joint Commissioner, by which, her challenge to the registration of khatha in favour of Ravichandra - respondent no.2, has been upheld. 2. Learned Counsel for the respondent no.2 submits that as a matter of fact, petitioner has instituted a suit in O.S.No.7477/2014 seeking for partition and the same is pending adjudication. 3. In light of the fact that the suit for partition is pending in which the subject matter of the property for which the dispute regarding khatha is pending adjudication, it would be unnecessary to interfere with the said order passed by the Joint Commissioner. 4. It is however made clear that registration of khatha in respect of respondent no.2 - Ravichandra would be subject to the outcome of the decision to be rendered by - 4 - NC: 2025:KHC:678 WP No. 53764 of 2018 the Civil Court in O.S.No.7477/2014.
