SREENIVASA REDDY Criminal Appeal Nos.42 and 860 of 2008 Common Judgment: Since the parties, and the issue involved, in both the Criminal Appeals are one and the same, they are being disposed of, by this common Judgment. 2. Criminal Appeal No.42 of 2008 has been preferred by the complainant against the Judgment dated 15.11.2007 passed in CC No.1 of 2007 by the learned IV Additional Junior Civil Judge, Kadapa. 3. Criminal Appeal No.860 of 2008 has been preferred by the same complainant against the Judgment dated 24.03.2008 passed in CC No.2 of 2007 by the learned IV Additional Junior Civil Judge, Kadapa. 4. On earlier occasion i.e., on 12.03.2025, as Sri Raja Reddy Koneti, learned counsel appearing on behalf of the appellant/complainant in Criminal Appeal No.42 of 2008, submitted that he has no instructions from the appellant and the appellant is not in touch with him for the last several years and his 2 whereabouts are not known, this Court ordered to issue bailable warrant against the appellant/complainant. 5. Pursuant to the same, the Superintendent of Police, YSR Kadapa district was directed to execute the bailable warrant issued against the appellant/complainant and produce him before this Court on 16.04.2025 at 10.30 AM. In obedience to the said direction, the Superintendent of Police deputed PC-619 namely MV Kiran Kumar of Kadapa I Town UG Police Station with instructions to execute the bailable warrant issued by this Court in Crl.A.No.42 of 2008 against the appellant/complainant. 6. Today, when the matter came up for hearing, learned Additional Public Prosecutor appearing on behalf of the respondent/State, produced the report of PC-619 along with Photostat copy of death certificate of the appellant/complainant dated 19.07.2021 issued by the Municipal Corporation, Kadapa, showing that the appellant/complainant died on 03.07.2021. 7. In the report filed by PC-619 it is stated that on causing enquiries with the kith and kin of the appellant/complainant it has come to know that the appellant died on 03.07.2021 and in 3 support of the same he filed Photostat copy of death certificate of the appellant/complainant dated 19.07.2021 issued by the Municipal Corporation, Kadapa. 8. At this stage, learned counsel appearing on behalf of the appellant/complainant submits that since the appellant/complainant died and none of his legal heirs are in contact with him, no orders are necessary to be passed in the present Criminal Appeals. 9. In view of the aforesaid facts and circumstances of the case, both the Criminal Appeals are closed. As a sequel thereto, the miscellaneous petitions, if any, pending in these Criminal Appeals, shall stand closed. ________________________ K. SREENIVASA REDDY, J.
