[2025:RJ-JP:38367] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No.8408/2025 Fareed Ahmad S/o Babu Khan, Aged About 38 Years, R/o Ward No. 3, Truck Stand Sindhi Colony, Malpura, P.S. Malpura, District Tonk (Accused Presently Confined In Sub Jail, Malpura). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. N.A. Naqvi, Sr. Adv. with Mr. Syed Adeel Naqvi, Adv. and Mr. Sahil Khan, Adv. and Mr. Happy Sharma, Adv. For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 18/09/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.104/2025, registered at Police Station Malpura, District Tonk, for the offence(s) under Sections 318(4), 319(2), 338, 336(3), 340(2), 347(2) and 61(2) of BNS. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated under Sections 189(2), 115(2), 126(2), 333, 303(2), 304(2), 307 and 310(2) of BNS. It is contended that the other co-accused namely- Vishnu Prakash Vijay, Shubham and Gheesalal Gosawami have already been enlarged on bail by the trial Court. The case of the present [2025:RJ-JP:38367] (2 of 3) [CRLMB-8408/2025] petitioner is not distinguishable from the case of the other co- accused. It is further contended that the alleged offence is exclusively triable by Magistrate and the accused-petitioner is in custody since 30.05.2025, charge-sheet has already been submitted before the concerned Court, there is no criminal antecedents against the accused-petitioner and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail and contended that the accused-petitioner in conspiracy with the other co-accused, generated fake names and forged certificates of several persons, therefore, considering the gravity of the offence, the bail application deserves to be dismissed. 4. Heard and perused the material available on the record. 5. Without commenting anything on the merits of the case. Considering the fact that the alleged offence is exclusively triable by Magistrate and the charge-sheet has already been submitted, there are no criminal antecedents against the accused-petitioner, the other co-accused- Vishnu Prakash Vijay, Shubham and Gheesalal Gosawami have already been enlarged on bail by the trial Court itself and trial of the case may take considerable time, therefore, I deem it proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- Fareed Ahmad S/o Babu Khan, in connection with FIR No.104/2025, registered at Police Station Malpura, District Tonk, shall be enlarged on bail provided he furnishes a personal bond in [2025:RJ-JP:38367] (3 of 3) [CRLMB-8408/2025] the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
