In view of the submissions made by learned counsel for the applicants/appellants and for the reasons mentioned in the application bearing No.1500/2024 filed under Section 5 of the Limitation Act for condonation of delay, same is allowed and the delay of one hundred eight (108) days’ in filing the restoration application is condoned. The present restoration application has been filed by the applicants for restoration of S.B. Civil Misc. Appeal No.1045/2018 which was dismissed vide order dated 12.02.2024 in furtherance of per-emptory order dated 03.10.2023. Having regard to the submissions made by learned counsel for the applicants and for the reasons mentioned in the restoration application, same is allowed subject to payment of cost of Rs.1000/- with the Rajasthan High Court Munshi Sangh, Jaipur Bench.
