The present petition has been filed for transfer of Matrimonial Suit No. 134 of 2023 pending in the Court of learned Fast Track Court-I, District Judge, at Howrah to the Court of learned Additional District Judge at Baruipur, District – South 24 Parganas. Learned counsel appearing on behalf of the petitioner submits that petitioner is suffering certain ailments and also apprehensive her safety and security at Howrah. He further submits that petitioner is residing at Sonarpur, District South 24 Parganas, Kolkata, which is closer to the Court of learned Additional District Judge, Baruipur, South 24 Parganas. Learned counsel for the petitioner submits that, the matter may be transferred from the learned Court of Fast Track Court-I, District Judge, at Howrah to the Court of learned Additional District Judge at Baruipur, District – South 24 Parganas. Learned counsel appearing on behalf of the opposite party on instruction has very graciously submitted that in order to balance the interest of both the parties, the matter may be transferred to the Court of learned District Judge, South 24 Parganas at Alipur. Learned counsel for the petitioner on instruction accepted the same. In view of the submissions made by both the parties, the Matrimonial Suit No. 134 of 2024 pending in the Court of learned Fast Track Court-I, District Judge, at Howrah is withdrawn and assigned to the Court of learned District Judge, South 24 Parganas at Alipur for disposal in accordance with law. Transferor Court is directed to send the entire record to the transferee Court within a period of thirty days from the date of receipt of the copy of the order. A copy of the order also be sent to the Court of learned Fast Track Court-I, District Judge, at Howrah and Court of learned District Judge, South 24 Parganas at Alipur for necessary compliance. Parties are directed to appear before the transferee Court on 10.6.2025. The matter stands disposed of along with all connected pending applications.
