CORAM : HON’BLE DR. JUSTICE S.N. PATHAK
------ For the Petitioner : Ms. Ayushi, Advocate For the Opp. Parties : Mr. Ranjan Kumar, AC to Sr.SC-V
-----
5/ 10.01.2025 The instant civil miscellaneous petition has been filed for modification of order dated 01.04.2022 passed in Cont. Case (Civil) No. 38 of 2020, whereby on the basis of submissions of the learned counsel for the opposite parties, the contempt proceeding has been dropped.
It appears that though on the submission of learned counsel for the opposite parties that the order dated 29.11.2019 passed in W.P.(S) No. 6437 of 2016 has been fully complied with, the contempt petition was
disposed of, but actually no compliance has been shown by the opposite parties to the order dated 29.11.2019. However, in such circumstances, no modification in the order dated 01.04.2022 passed in Cont. Case (Civil) No. 38 of 2020 is permitted at this stage, except to file fresh writ petition ventilating his grievance.
As such, the petitioner is at liberty to raise his grievance by way of fresh writ petition.
This civil miscellaneous petition is accordingly disposed of.
