This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.60/2025 registered at Police Station Bhatapara(Rural), District Baloda-Bazar-Bhatapara (C.G.) under Section 303(2), and 3(5) of BNS. 2. As per prosecution, in brief, is that, the complainant Rakesh Kumar Yadav lodge the complaint on 21.01.2025 stating that on 19.01.2025 at about 02:00 pm he was present in the near the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA
2 fortune shop of Balram Dhruw in the mean time two unknown person came on the spot and demanded his mobile phone to call the someone and when the complainant given his mobile phone the unknown person took his mobile and run away from the spot, thereafter the complainant lodged the complaint against unknown person. 3. It has been argued by learned counsel for the applicant that the applicant has been falsely implicated in this case and the applicant has neither committed theft of any article. He also submits that the prosecution has not collected the sufficient material from the possession of the applicant regarding theft article. He further submits that only on the basis of merely suspicious applicant has been implicated in the present case. The applicant has 9 previous criminal antecedents under the same nature of crime and he is in jail since 23.01.2025 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned counsel appearing for the State/non-applicant would oppose the bail application and submit that applicant has 9 previous criminal antecedent under the same nature of crime, looking to the conduct of the applicant he is not entitled for grant of bail. 5.
I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and considering the fact that applicant is having 9 previous
3 criminal antecedent under the same nature of crime, as per memorandum statement of the co-accused, present applicant was involved in the above offence, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the first bail application of the applicant– Shekhar Tandan filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.60/2025 registered at Police Station Bhatapara(Rural), District Baloda-Bazar- Bhatapara (C.G.) under Section 303(2), and 3(5) of BNS., is rejected.
