Criminal Miscellaneous Bail Application No. 7703/2024 Abhishek Jangid S/o Ramesh Chand Jangid, Aged About 34 Years, R/o Village Gandala Majri, Tehsil Behror, District Khairthal- Tijara. ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Dinesh Chand Sharma For Respondent(s) : Mr. Rajendra Singh Shekhawat, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 02/01/2025 1. Petitioner has filed this miscellaneous bail application under Section 438 Cr.P.C. 2. F.I.R. No. 0111/2022 was registered at Police Station Chopanki, District Bhiwadi for offences under Sections 420, 406, 467, 468, 471, 506 & 120-B of IPC. 3. It is contended by counsel for the petitioner that the accused-petitioner has been falsely implicated in this case. Counsel for the petitioner submits that impugned FIR has been lodged in this matter after great delay of 8 years for which no explanation is available on record. Essentially, there is a civil dispute between the parties and complainant wants to settle the civil dispute in the garb of criminal investigation. He further submits that custodial interrogation of the petitioner is not (2 of 2) [CRLMB-7703/2024] required in this matter. He thus, prays that instant bail application under Section 438 Cr.PC may kindly be allowed. 4. Learned State counsel opposes the submission made by the counsel for the petitioner. He submits that as per the FIR petitioner and co-accused induced the complainant and other persons to purchase the plots in the society of the petitioner’s namely Madhuban Housing Society. Believing on the assurance given by the petitioner, a handsome amount was paid by the complainant to the petitioner and other co-accused. Thereafter, several requests were made by the complainant and other persons to get executed the sale-deed in their favour but same was not done. Therefore, present FIR was lodged by the complainant. 5. I have considered the contentions. 6. Having regard to the totality of the facts and circumstances of the case and looking to the nature of allegation and cheating committed by the petitioner in a very planned manner, but without commenting anything on the merits/demerits of the case, I am not inclined to accept this anticipatory bail application. Accordingly, the anticipatory bail application is dismissed. (ANIL KUMAR UPMAN),J ANANDTANWAR/108
