This application has been filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita,2023 for granting bail to the accused in connection with Dimapur East Police Station Case Page No.# 2/2 No.189/2024 under section 309(4)/304/3(5) of the Bharitiya Nyaya Sanhita 2023 corresponding to G.R. Case No.620/2024. On a query by this Court as to why the applicant has approached this Court for bail at the first instance, the learned counsel for the applicant has submitted that the bail in connec- tion with the present case was rejected by the Judicial Magis- trate First Class Dimapur. In paragraph 14 of the application the accused/peti- tioner has however averred that the accused/petitioner has ap- proached this Hon’ble Court for the first time seeking for regular bail. On the face of the submissions made by the learned counsel for the applicant, it appears that there is mis representa- tion in the application. The bail application is accordingly dismissed.
