Despite service of notice, the respondent no. 5 has not appeared in the instant writ proceeding. After hearing the learned counsel for the parties for some length, Mr. Yanger Wati, learned counsel for the petitioner has submitted that the petitioner may be allowed to withdraw the writ petition with the liberty to file afresh with better particulars. The said prayer of Mr. Yanger Wati has not been opposed by Mr. Longkumer, learned Government Advocate, Nagaland. In view of the above submission made by Mr. Yanger Wati, learned counsel for the petitioner, the writ petition is dismissed on withdrawal, with the liberty, as prayed for.
