ORDER: \ ii. Dr. YLR, J CrI.P.No.6724 of 2025 belted 23.07.2025 The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity l{he BNSS]) by the petitioner/Accused No.3 for granting of pre-arrest bail in connection with Crime No.81 of 2025 of Prohibition & Excise Station, Chittoor District, registered for the alleged offences punishable under Sections 7 (B) read with 8 (A), 8 (C) (a) of Andhra Pradesh Prohibition Act,1995. 2. The case of the prosecution is that on 22.05.2025, on receipt of credible information from the Inspector, Prohibition & Excise, Chittoor Urban, the Sub-Inspector of Police, along w'lth staff and mediators, proceeded to the scene of offence, which is situated a{ Nalla Venkatayya Gari Pall'l Das, Talambedu to Perumal Kandriga bus road, Chittoor Rural Mandal, and conducted road watch at the Said Place. The police noticed an auto approaching them. On seeing the police, the driver of the auto tried to escape from the place. Then the police apprehended the driver and one female along with one hea'Jy bag. The police opened the said bag and they found 150 arrack packets of 100 ml each, totaling 15 liters. Later, the police seized the said auto and arrested the Accused Nos.1 / I. `-I

Sri D.Purna Chandra Reddy, the learned counsel forthe petitioner, subml'ts that the petitio.ner is a lady; the petitioner has not committed any offence; she was falsely impII-Cated in this case; she is ready to abide any conditions to be imposed by this court; and urged to grant pre-arrest bail to the petitioner/Accused No.3. 4. . Per confra, Ms. P.Akila Naidu, the learned Assistant Public Prosecutor, opposed I-n granting of bail stating that investigation is not yet `completed; if the petitioner is granted pre-arrest baI-I, she will repeat the same offence and urged to dismis,s the baI|I petI'tiOn. 5. Perused the record. 6. As seen from the record,'based on the confession of Accused Nos. 1 and 2, the petitioner was shown as Accused No.3 I'n this Case. Accused Nos.1 and 2 were found in possession of 50 liters of ID liquor.

Consl-dering the nature of the allegations leveled against the Petitioner/Accused No.3, her alleged role played in this case, this court deems it fit to grant pre-arrest baI|l tO the Petitioner/Accused No.3. 8. In the result, the Criminal Pe.tition is allowed with the following condI'tI-OnS.I i. In the event of her arrest, the petitioner/Accused No.3 shall be enlarged on bail subject to she executing a Personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting poll-Ce Officials; ii. The. peti`tioner/Accused N.o.3 shall make herself avaI-lable for investigation as and when required,- iii. Thepe{itioner/AccusedNo.3shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The petitioner/Accused No.3 shall appear before the Station House OffI'Cer concerned Once I-n a Week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet.
