The petitioner is apprehending his arrest in connection with Gumla P.S. Case No.175/2025, registered for the offence under Sections 115(2)/109/3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the learned Chief Judicial Magistrate, Gumla. 3. Learned counsel for the petitioner submits that the name of the petitioner has come on suspicion only and the petitioner was not present on the spot and even the allegation of assault is not against the petitioner and that is against unknown person due to which injury has been received by Adhnu Gope, who is the brother of the informant. 4. Learned counsel for the State opposed the prayer and submits that even the injured person is not able to speak and in view of that, his statement has not been recorded. 5. It transpires that the allegation of assault is there against unknown persons due to whose assault injury has been received by Adhnu Gope, who is the brother of the informant and there is only allegation against the petitioner that the person who has assaulted brother of the informant, has ( 2025:JHHC:27484 ) -2- A.B.A. No. 5236 of 2025 fled away towards the house of the present petitioner and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S.
