2. Case of the prosecution, in brief, is that on 10.08.2023, applicant along with other co-accused persons, stole the mobile of the complainant namely Ratan Singh Kshatriya, meanwhile transferred the amount from his account and later threw out the SIM card. Hence, the aforesaid offence was registered.
3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submits that there are 6 previous criminal antecedents against the applicant, however, he has already been acquitted in all the cases. He would further submit that the applicant is in jail since 09.12.2024 and the charge sheet has been filed in the present case. Considering the backdrop, he prays for grant of regular bail to the applicant.
4. Learned counsel for the State/non-applicant opposes the bail application and submits that the charge-sheet has been filed in this case. He would further submit that Rs.15 lakhs has been withdrawn from the complainant’s mobile, therefore, this application may be rejected.
5. I have heard learned counsel appearing for the parties and perused the case diary.
6. Taking into consideration the facts and circumstances of the case,
submissions of learned counsel for the parties as also the nature of crime and the amount of money which was withdrawn by the applicant from complainant’s mobile, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
