1. Heard Ms. Shriya Daga, Advocate appears on behalf of Mr. Dhiraj Kumar Wankhede, learned counsel for the petitioner as well as Mr. Kawaljeet Singh Saini, learned Panel Lawyer for the State/respondent/s.
2. At the very outset, learned counsel for the petitioner submits that during the pendency of this petition in a departmental enquiry has been completed and final order is not passed, therefore he is seeking withdrawal of this petition with a liberty to approach to respondents to decide the case of the petitioner directly in light of the judgment passed by the Hon’ble Supreme Court in the matter of State (Govt. of NCT of Delhi) vs Pankaj Chaudhary) reported in (2019) 11 SCC 575 and also in the matter of W.P.(CR) No. 544/2020 Laxman Kumeti vs. State of Chhattisgarh.
3. On the other hand, learned State counsel would not oppose the submission made by learned counsel appearing for the petitioner.
4. As such, also heard on I.A. No.2, which is an application for withdrawal of writ petition and same is allowed for the reasons mentioned in the application.
5. Accordingly, this petition is disposed of as withdrawn with a liberty to the extent as prayed for.
